Conditions of sale of the art of Mihaela Georgieva and MG ARTS GALLERY.
The following General Terms and Conditions are publicly available and apply to every customer of Mihaela Georgieva and MG ARTS GALLERY.
By purchasing the work of Mihaela Georgieva and MG ARTS GALLERY, you agree with them.
Terms apply to art ordered through www.mgartsgallery.com and the physical MG ARTS GALLERY.
1. Terms of sale:
1.1 The customer chooses a work of art from Mihaela Georgieva's gallery through the website www.mgartsgallery.com Facebook page or Instagram, including other online platforms for direct sale or live in the physical studio - MG ARTS GALLERY located at the address: town of Veliko Tarnovo, 15 Stefan Stambolov St.
1.2 The customer places an order through the website www.mgartsgallery.com.
1.3 The order is confirmed in writing by email, Facebook, Instagram or on the relevant direct selling platform, in person between the two parties. Upon confirmation of the agreement, the announced price of the work is also confirmed, as well as the delivery price.
1.4 Mihaela Georgieva undertakes to fulfill the order placed by the client.
1.5 Mihaela Georgieva undertakes to deliver all works of art requested by the client to the buyer in good commercial condition.
1.6 Mihaela Georgieva undertakes to fulfill the order within the agreed period /when making a custom painting/, as well as for orders through the website, online platforms or the physical gallery.
1.7 Mihaela Georgieva has the right to extend the deadline for the execution of a custom painting by up to 14 working days, through a written agreement with the client.
1.8 When making a picture to order, it is necessary to know that each work has a necessary drying time. Do not transport wet.
2. Terms of delivery:
2.1 Delivery outside the Republic of Bulgaria.
2.1.1 Delivery to the territories of the Republic of Bulgaria is carried out with the courier company EKONT.
2.1.2 The delivery to the Republic of Bulgaria is carried out by the courier company EKONT and couriers of the EKONT company, to their pre-arranged office convenient for the customer or to an exact address indicated by the customer.
2.1.3 Delivery outside the Republic of Bulgaria takes place within one to two working days.
2.1.4 All deliveries with EKONT sent by Mihaela Georgieva are entitled to inspection and insurance by EKONT.
2.1.5 Delivery to Veliko Tarnovo.
2.1.6 Mihaela Georgieva offers to pick up a work of art in person from a physical studio - MG ARTS GALLERY, located at: Veliko Tarnovo, 15 Stefan Stambolov Street.
2.2 Delivery abroad
2.2.1 Delivery abroad is carried out through the services of Bulgarian Posts AD, and the price for delivery, as well as the terms of delivery, are determined by Bulgarian Posts AD.
3. Pricing of Mihaela Georgieva's works
3.1 The prices of Mihaela Georgieva's paintings are mentioned in the description of each painting published on the site, as well as of each in the physical studio, announced for sale.
3.2 The mentioned prices are in Bulgarian leva, including VAT.
3.3 The prices are valid for all customers of Mihaela Georgieva and MG ARTS GALLERY and do not include additional shipping costs or brokerage fees for payment of goods (Pay Pal, bank services, cash on delivery, etc.). All additional costs are borne by the customer.
4. Terms of payment:
4.1 Terms of payment for the Republic of Bulgaria.
4.1.1 For the Republic of Bulgaria, payments to Mihaela Georgieva or MG ARTS GALLERY or through the website are made by bank transfer or cash on delivery through the services of the courier company EKONT.
4.1.2 When ordering a work of art that the client wishes to be painted to order by Mihaela Georgieva, within the borders of the Republic of Bulgaria, the client undertakes to pay 50% of the value of the entire agreed amount for the order by bank transfer, provided by Mihaela Georgieva bank account, as well as the rest of the amount due upon receipt of the already completed work, upon receipt of the shipment.
4.1.2.1 Upon receipt of the shipment or collection in person from the atelier, the customer has the right to an inspection. When collected from the office of the courier company EKONT, in the event of damage to the shipment, the security deposit from the courier company EKONT comes into effect.
4.1.2.2 Depending on the damage, an additional protocol is carried out to indemnify the customer.
4.1.3 After acceptance of the shipment, responsibility for it is transferred to the customer.
4.2 Conditions for payment abroad
4.2.1 Mihaela Georgieva accepts payments from abroad by bank transfer, as well as through the Western Union platform. All payment fees are charged above the advertised sales amount.
4.2.2 Deliveries by Mihaela Georgieva intended for customers outside the Republic of Bulgaria are made after 100% advance payment has been received using one of the methods mentioned in point 4.2.1
4.3. Terms of payment for discounted artwork
4.3.1 When ordering a work of art at a reduced price from www.mgartsgallery.com, the order is only confirmed after payment of the full value of the work/s within 5 (five) business days.
5. Refund and Return Policy
5.1. Return conditions
You, as a consumer, have the right to refuse the ordered goods within 14 working days of receiving the goods, in case they have not been used, the integrity of their packaging has not been violated and in the form in which it was received and the conditions under Art. 55 of the Civil Code. Transport and other costs of receiving and returning the goods are at the customer's expense. In case of non-compliance of the goods with the characteristics indicated on the page, the supplier refunds the entire amount paid by the user, including the transport costs paid by the user for the acquisition of the goods in accordance with Art. 59 para. 3 of the PPE and within 14 working days of receiving the goods and the undamaged commercial appearance of the goods and packaging.
5.2 According to the Consumer Protection Act - Article 55, Paragraph 1, you may return or replace the purchased goods within 14
daily period from the date of receipt, mandatory with receipt/receipt! Provided that the goods are
returned in the condition in which it was received and maintained in good merchantable condition (ie the item is not
torn, punctured, stained, treated with detergents, washed, burnt, replaced or etc.)
5.3 Transport costs for delivery and return of goods are for the customer's account. The 14-day period starts from the date of use of the goods by the customer. Upon receipt of the shipment, you must check the contents of the package for compliance of the goods with the request.
In case of violations in the appearance of the goods that occurred during transport, you should contact the courier for a damaged shipment report.
6. Refund Terms
6.1. The returned product/s must be unused and in good merchantable condition (as received by the customer) and you have the right to return it within a period of no longer than 14 days from the date of receipt.
6.2. The customer pays all costs related to the transportation/return of the product/s to Address: 15 "Stefan Stambolov" St., Veliko Tarnovo p.c. 5000, next to MG ART GALLERY, Mihaela Georgieva.
6.3. A customer has the right to return a product OR exchange a product only if the product is in a neat, complete and undamaged commercial condition, keep a receipt of receipt of money order issued by the courier. This receipt has the effect of a receipt and must be applied to the returned product/s.
6.4. When returning a product(s), the amount is refunded via bank transfer to the customer. For this purpose, the customer must provide us with a bank account with the name of the holder at mihaela.georgieva07@yahoo.com
